JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.41379/2025, pending before the Court of VI A.C.J.M, Bengaluru, for the offences under Sections 351(2) and 352 of BNS, 2023. 2. Heard Sri. Pancham R.D, learned counsel appearing for the petitioner, Sri.K.Nageshwarappa, learned HCGP appearing for respondent No.1 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:28709 CRL.P No. 2833 of 2026 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the affidavits of petitioner and respondent No.2. The affidavit of the petitioner reads as follows: "I, Raghavendra, S/o. Nagendra, Aged about 44 years, R/at Higiri, 29th Cross, Mallige Road, SIT Extension, Bangalore- 560003, do hereby solemnly affirm and state on oath as follows; 1. I state that I am the Petitioner in the above case, as such I know the facts of the case. Hence I am swearing to this affidavit. 2. I state that we have filed the above Criminal Petition to quash the charge sheet filed by Respondent No.1 in C.C.No.41379/2025, for the offences punishable under Sec 351(2), 352 of BNS, pending on the file of the Court of VI Addl. Chief Judicial Magistrate, Bengaluru, against me. The averments made in the main petition may kindly be read as part and parcel of this affidavit in order to avoid repetition of facts. 3. I state that during the pendency of the above petition, at the intervention of common friends and elders, I and the respondent No.2 have settled our dispute stating that the complaint filed by the respondent no.2 against me is misconceived. Hence this application. 4. I state that there is no coercion, threat, undue influence in filing the annexed application for compounding of the offences. WHEREFORE, I pray this Hon'ble court be pleased to allow the annexed application as prayed for, in the interest of justice and equity. The affidavit of respondent No.2 reads as follows: "Praveen N., S/o. Nagaraju, aged about 39 years, R/at No.11. Yashaswini Layout, Muddinapalya Main Road, Nagarabhavi, Bangalore-560072, do hereby solemnly and affirm and state on oath as follows: 1. I state the I am the Respondent No.2 in the above case. I know the facts of the case. Hence, I am swearing to this affidavit. 2. I state that the petitioner has filed the above Criminal Petition to quash the charge sheet filed by Respondent No.1 in C.C.No.41379/2025, for the offences punishable under Sec 351(2), 352 of BNS, pending on the file of the Court of VI Addl. Chief Judicial Magistrate, Bengaluru, against the petitioner. 3. I state that during the pendency of the above petition, at the intervention of common friends and elders, I and the petitioner have settled our dispute stating that the complaint filed by me against the petitioner is misconceived. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.41379/2025, pending before the Court of VI Addl.
