Heard Ms. Fouzia Mirza, learned Senior Advocate, assisted by Mr. Ali Afzaal Mirza, learned counsel for the petitioner. Also heard Mr. S.S. Baghel, learned Government Advocate, appearing for the State/respondents No. 1 to 4 and Mr. Anshul Tiwari, learned counsel, appearing for respondent No. 5. 2. The present petition has been filed by the petitioner with the following prayers: “10.1 That, this Hon’ble Court may kindly be pleased to call for the entire record concerning the case of the petitioners from the possession of the respondent authorities for its kind perusal. 10.2 That this Hon’ble Court may kindly be please to quash the FIR bearing Crime No. 309 of 2026, dated 01.05.2026 registered at Police Station – Khamtarai Raipur, District Raipur (C.G.) offence punishable under Section 420, 409 of IPC (Annexure P/1). 3 10.3 Any other relief or relief(s) which this Hon’ble Court may deem fit or proper in the facts and circumstances of the case.” 3. Learned Senior Advocate for the petitioner submits that the petitioner and respondent No. 5/complainant were known to each other for several years and, on account of such acquaintance, the complainant and his family members had invested amounts in various insurance policies through the petitioner. Subsequently, disputes arose between the parties regarding such investments and issuance of insurance policies, pursuant to which the present FIR came to be registered. It is submitted that the dispute is essentially personal and financial in nature. 4. It is further submitted by the learned Senior Advocate, appearing for the petitioner that the parties have amicably settled their disputes on 02.05.2026. A copy of the compromise agreement has been placed on record as Annexure P/2. 5. Learned counsel appearing for respondent No. 5 affirms the submissions made on behalf of the petitioner and admits both the factum and validity of the compromise entered into between the parties. 6. We have heard learned counsel for the parties and have carefully perused the record, including the pleadings, the reliefs sought and the documents placed on file. 7. Considering the fact that the matter is still under investigation and the compromise alleged to have been entered into between the parties 4 is required to be verified, we deem it proper to direct that the petitioner as well as respondent No. 5 shall appear before the Investigating Officer, Police Station Khamtarai, Raipur, District Raipur (C.G.) within a period of one week from today along with a certified copy of this order and the original compromise deed (Annexure P/2). The Investigating Officer shall verify the genuineness, voluntariness and authenticity of the compromise entered into between the parties and shall thereafter submit a detailed report before the competent Court within a period of three weeks thereafter. 8. While carrying out the aforesaid exercise, the Investigating Officer shall also take into consideration the nature of the dispute between the parties, which appears to have arisen out of transactions relating to investment in insurance policies, and shall proceed further strictly in accordance with law. 9. Registry is directed to return the original compromise deed (Annexure P/2) to learned counsel for the petitioner after obtaining a photocopy of the same for being retained on record. 10.
