The petitioner is apprehending his arrest in connection with Hunterganj P.S. Case No. 194 of 2022, registered for the offence under Sections 420, 465, 414 / 34 of Indian Penal Code and Sections 25(1- B)(a), 26, 35 of Arms Act, pending in the court of learned Judicial Magistrate, 1st Class, Chatra.

Learned counsel appearing for the petitioner submits that the name of the petitioner has come on the basis of confessional statement and one pistol and one live bullet have been recovered from one Ganesh Bharti. He next submits that further the motorcycle used in the crime also belongs to Pravesh Bharti and the said Pravesh Bharti has already been provide the privilege of anticipatory bail in A.B.A. No. 3260 of 2024 by the co-ordinate bench. He then submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-11 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the name of the petitioner has come on the

basis of confessional statement.

Considering that the name of the petitioner has come on the basis of confessional statement and further the owner of the motorcycle, which was used in the crime has already been provided the privilege of anticipatory bail as aforesaid and the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-11 of the petition, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
