As per the averments made in the FIR, over an issue of property, the petitioners extended threats and physically assaulted the Complainant (Respondent no. 2 herein) using an iron knuckle type object and Respondent no. 3 and 4, when they tried to intervene, thereby causing injuries to them. 3. It is submitted by the Learned, APP that Charge-sheet has been filed under Sections 332(c)/351(2)/115(2)/191(2)/3(5) BNS. 4. During the course of proceedings, the parties amicably resolved their disputes and the terms of the compromise were reduced into writing in the form of a Deed of Settlement/Compromise dated 17th September, 2026. Copy of the Deed of Settlement/Compromise dated 17th September, 2026 is annexed as Annexure P2. 5. Learned Counsels for both the parties submit that as per the settlement, parties have resolved the disputes and Respondents have agreed to get the present FIR quashed. 6. 8. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners. 9. Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 10.
Since State machinery has been put into motion, in order to secure the ends of justice, FIR No. 214/2026, dated 4th May, 2026, registered at P.S Kapashera, Delhi under Sections 115/332(c)/351(2)/3(5) BNS, along with all consequential proceedings emanating therefrom, is hereby quashed subject to the petitioners depositing Rs. 5,000/- each as cost with Delhi State Legal Services Authority (DSLSA) within a period of 30 days. Original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court, so that these become part of Trial Court Record and shall also be submitted to concerned SHO/IO within four weeks from today. 11. Petition is allowed and disposed of accordingly. 12. Pending application(s), if any, also stand disposed of.
