KAMAL ORAL ORDER Petitioner being aggrieved by the action initiated by the respondent-bank under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act) is before this Court. 2. Ground raised is with regard to the proposal for one time settlement not having been accepted by the respondent- bank in full and final settlement. 3. Learned counsel for respondent submits that one time settlement proposal has lived its life in view of passage of time besides petitioner has not complied with the one time settlement terms. 4. Since statutory and appropriate remedy is provided, reserving liberty to petitioner to avail such remedy, petition is disposed of. 5. Notwithstanding the dismissal of the petition, petitioner is at liberty to seek for one time settlement if - 3 - HC-KAR NC: 2026:KHC:28184 WP No. 18860 of 2022 permissible under the Banking Regulations and terms of loan agreement. 6. Time consumed in prosecuting this petition shall be considered for the purpose of condonation of delay if steps are taken within one month from the date of receipt of certified copy of this order.
