... Non-applicant For Applicant : Mr. Dhirendra Prasad Mishra, Advocate. For Non-Applicant/State : Ms. Ritika Verma, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 15.06.2026
1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 47/2026 registered at Police Station Chakradharnagar, District - Raigarh (C.G.), for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. As per the prosecution story, on 13.02.2026, Assistant Sub-Inspector Aashiq Ratre of Police Station Chakradharnagar conducted a raid near Balsamand Nala on Pahad Mandir Road, within the jurisdiction of Police Station Chakradharnagar. During the raid, a total quantity of 21.378 kg of ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.06.16 15:01:17 +0530
2 narcotic substance ganja, one car bearing registration No. CG-13 AM- 3522, and one mobile phone of One Plus company were seized from the possession of accused Ajit Singh. Thereafter, Crime No. 47/2026 was registered under Section 20(b) of the NDPS Act and the matter was taken up for investigation. The accused was arrested and his memorandum statement was recorded, wherein he stated that he had illegally transported ganja contained in 20 brown packets kept inside a plastic bag. It was further stated by him that he had purchased the said narcotic substance from Shibbu Sahu, a resident of Jharsuguda, and had brought the same for the purpose of sale. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case and he is in jail since 13.02.2026. He would further submits that the mandatory provisions with regard to search and seizure were not complied. He would also submits that the applicant is having no criminal antecedent against her and the conclusion of the trial may take quite long time. Accordingly, he prays for enlarging the applicant on regular bail. 4.
Learned counsel appearing for the State/non-applicant would oppose the bail application and submit that though the charge-sheet has not filed in the present case before the competent Court, the contraband artice i.e. 21.378 kg of narcotic substance ganja recovered from the possession of the applicant, which is much above the commercial quantity and as such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. From perusal of the case diary, it transpires that the article which has been seized from the possession of the applicant is much above the
3 commercial quantity and the applicant has not been able to give an explanation of the same, further it cannot be a case of false implication. 7. Accordingly, the bail application of the applicant - Ajit Singh, involved in Crime No. 47/2026 registered at Police Station Chakradharnagar, District - Raigarh (C.G.), for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. - Sd/-
