Judgment 12/01/2026
1. By way of the present petition, the award dated 27.02.2025 has been put to challenge, whereby the claim petition filed by the petitioner has been rejected.
2. Considering the submissions put forth and upon perusal of the material available on record, it has been observed that the learned Tribunal held that prior to the termination order dated 07.08.2010, the petitioner did not serve his of 240 or more continuous days service in the calendar year immediately preceding to the date of termination i.e. in-between the period of 07.08.2009 and 06.08.2010. It has further been observed that the learned Tribunal has categorically held that there is no concrete evidence on record, rather only vague assertions, in support of the petitioner’s contention regarding payment credited to his account
[2026:RJ-JP:1096] (2 of 2) [CW-306/2026] has been pleaded. The reliance has also been placed upon several judicial precedents in support of the said findings by the learned Tribunal. Moreover, it has been observed that after detailed
reasoning and consideration of the material available on record therein, the learned Tribunal has dismissed the claim petition filed by the petitioner.
3. In view of the categorical findings of facts and circumstances recorded by the learned Tribunal, this Court deems it fit to dismiss the present petition, as no perversity is found in the award dated 27.02.2025 passed by the learned Tribunal.
4. Accordingly, the present petition is dismissed. Pending applications, if any, shall stand disposed of.
