The Petitioner herein is A-2, whose bank account has been freezed in connection with the above crime. The Petitioner herein filed a petition seeking to defreeze the Petitioner’s Bank Account for interim custody in Crl.M.P.No.266 of 2025, wherein the learned Judge dismissed the said petition vide Order dated 17.03.2025. operations. It is contended that the said account requires to be defreezed forthwith in order to prevent further financial damage and disruption of legitimate commercial activities. It is further submitted that there are no substantive materials or supporting documents produced by the Prosecution to justify the freezing of the Petitioner’s bank account. The freezing of the account without adequate basis constitutes a grave error on the part of the Prosecution. Learned Counsel for the Petitioner finally prays to allow the revision by setting aside the impugned Order passed by the learned Trial Court and direct the concerned to defreeze the Petitioner’s Bank Account.
5.
Learned Counsel for Respondent Nos. 3 and 4 submits that the Bank Authorities froze the Petitioner’s bank account pursuant to the directions issued by the Investigating Officer in connection with the aformentioned crime. It is further submitted that the Bank Authorities have acted strictly in compliance with such directions and have no independent role in the matter.
Learned Counsel further contended that the Bank Authorities are ready and willing to defreeze the Petitioner’s bank account, subject to any directions that may be issued by this Hon’ble Court.
6. Learned Assistant Public Prosecutor submits that the investigation in the present crime is still pending. She prays that, if this Hon’ble Court is inclined to defreeze the Petitioner’s bank account, the disputed amount of Rs. 8,50,000/- may be kept frozen and the Petitioner may be permitted to operate the account for the remaining amount.

7. Considering the submissions made and upon perusal of the material available on record, and having regard to the contention of the learned counsel for the Petitioner that the subject bank account is a business account involving several financial commitments, this Criminal Revision Case is allowed. The impugned Order is hereby set aside. The concerned Bank Authorities are directed to permit the Petitioner to operate his bank account and withdraw the remaining amount standing to his credit, except the sum involved in the crime, i.e., Rs. 8,50,000/-, which shall continue to remain frozen.
Consequently, miscellaneous applications pending, if any, shall stand closed. __________________________________________ DR. JUSTICE VENKATA JYOTHIRMAI PRATAPA Date: 10.02.2026. UPS
