CWP No.4861 of 2026
Decided on 08th April 2026 Garib Dass
Petitioner Versus State of Himachal Pradesh and another
…Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge 1Whether approved for reporting? For the petitioner: Mr. Gurinder Singh Parmar, Advocate.
For the respondents: Mr. Pushpinder Jaswal, Additional Advocate General.
Ajay Mohan Goel, Judge (Oral)
By way of this petition, the petitioner has assailed his transfer order from Patwar Circle Sarkaghat to Patwar Circle Kullu on the ground that his mother is undergoing medical treatment from Himachal Heart Institute at Balh.
2.
This Court is of the considered view that the distance between the Kullu and Balh is not all that much that the petitioner cannot take care of his mother, being posted at Kullu. In fact, the medical facilities at Kullu are good and in case the petitioner intends to continue the treatment of his
2 mother at Balh, then also, the Balh is much better connected from Kullu as compared to Sarkaghat. Therefore, this Court does not find any merit in this petition, the same is dismissed.
4.
At this stage, learned counsel for the petitioner submits that liberty be granted to the petitioner that after joining at Kullu, he may approach the Authority for his adjustment at some other station. This liberty is granted to the petitioner. After joining at Kullu, if any such representation is filed by the petitioner, the same be decided by the Authority in light of the contents thereof within some reasonable time.
5.
Pending miscellaneous applications, if any, also stand disposed of.
