Issue a writ of Mandamus order or direction in the form of a writ to direct the 2nd and 3rd respondent to secure the minor child Prithvi Raj from the illegal custody of the 4th Respondent on the basis of the FIR registered in Crime No.81/2026 dated 22.04.2026 and produced before the Court under Annexure-D. ii. Issue writ of Mandamus order or direction in the form of a writ to direct the 2nd and 3rd respondent after securing the child from the illegal custody of the 4th Respondent and hand over to the petitioner or produce the minor child before the III Addl. District & Sessions Judge at - 3 - HC-KAR NC: 2026:KHC:25289 WP No. 15871 of 2026 Anekal in G&WC.No.5023/2024 to pass any order in accordance with law under Annexure-C. 2. Learned counsel for the petitioner-husband has raised several grounds in the petition which this court is not inclined to go into. It is submitted that the petitioner has filed I.A.No.5 before the Family Court and the same is pending consideration and there may be direction to the Family Court to consider the said application in accordance with law. 3. Learned Counsel appearing for the respondent-wife submits that all the allegations that were made by the petitioner are baseless. It is submitted that the present writ petition is not maintainable. 4. Having heard the learned counsel on either side, perused the entire material on record. Considering the respective submissions of the parties and considering the fact that IA.No.5 is pending before the family court, this court deems it appropriate to pass the following: - 4 - HC-KAR NC: 2026:KHC:25289 WP No. 15871 of 2026 ORDER i. The III Addl. District & Sessions Judge, Anekal (Family Court) is directed to dispose of I.A.No.5 in accordance with law within a period of 30 days from the date of receipt of the copy of the order. ii. I.A.No.5 filed under Section 12 of the G & WC Act shall be considered. iii. Accordingly, the writ petition is disposed of. iv. All pending IA’s in the petition shall stand closed.
