The incident in question happened on 18.11.2025. The petitioner immediately informed the wife of the victim and thereafter admitted the victim to the hospital. The victim passed away much later on 05.12.2025. The petitioner’s mother has earlier been granted anticipatory bail by this Court. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that the victim was admitted to the hospital by his daughter. The mother of the petitioner was however, granted bail as she was only an abettor and a lady, whereas in this case, the petitioner is the principal accused who assaulted the victim, causing him to fall and sustain a head injury. He relies on the post mortem report and the statements of witnesses. Considering the above, the other incriminating materials available in the case diary and the alleged role ascribed to the present 2 petitioner, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected.
