(Petitioner In District Jail Khetari, Jhunjhunu). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Ali Mohammed Khan, Adv. For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 07/01/2026
1. The instant second bail application has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.154/2023, registered at Police Station Pacherikalan, District Jhunjhunu for the offence(s) under Sections 8/20 of the N.D.P.S. Act. 2. It is contended by learned counsel for the petitioner that the petitioner's first bail application was dismissed alongwith the other co-accused Deepak on merits vide order dated 23.04.2024. However, the Hon'ble Apex Court vide order dated 12.12.2025 in the (SLP (Crl.) No.15781/2025)) filed by the other co-accused Deepak has enlarged him on bail. It is contended that the case of the petitioner and the period of custody is identical with that of the other co-accused, who have been enlarged on bail by the Hon'ble Apex Court, therefore, on the grounds of parity, the petitioner's bail application may be allowed. [2026:RJ-JP:261] (2 of 2) [CRLMB-17157/2025]
3. Learned Public Prosecutor has vehemently opposed the grant of bail and contended that vide detailed order dated 23.04.2024, this Court dismissed the bail application of the accused-petitioner on merits after considering the rigors of Section 37 of the N.D.P.S. Act. It is further contended that there is no change in circumstances; therefore, the present bail application filed by the accused-petitioner deserves to be dismissed. 4. Heard and perused material available on record. 5. The Hon’ble Apex Court, in a criminal appeal filed by the other co-accused Deepak, who was also nabbed at the place of occurrence along with the accused-petitioner and from whose possession contraband article ‘ganja’ was recovered, has enlarged on bail, therefore, considering the fact that the other co-accused Deepak has already been enlarged on bail and considering long period of incarceration, this Court deems it proper to allow the second bail application of the accused-petitioner on the ground of parity. 6.
6. Accordingly, the second bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, is allowed and it is ordered that the accused-petitioner-Anil S/o Badan Singh, in connection with FIR No.154/2023, registered at Police Station Pacherikalan, District Jhunjhunu, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
