The applicant disputes that he deceived the complainant by making a promise of marriage without intending to fulfil it. He relies upon their interactions and also a Settlement Agreement dated 19.08.2025. 4. The complainant, however, submits that the aforesaid agreement was signed under pressure. The question at this stage is whether the continued detention of the complainant is justified pending trial. The applicant relies upon the order of the Supreme Court dated 25.09.2026 passed in SLP (Crl.) No. 12596/2026, wherein it was observed as follows:- Digitally Signed By:ROHIT KUMAR PATEL Signing Date:08.10.2026 11:17:58 Signature Not Verified BAIL APPLN. 3313/2026 Page 3 of 6 5. The applicant further relies on the judgment passed by a Coordinate Bench of this Court in Shane Haider vs State of NCT of Delhi Through SHO PS Pahar Ganj, (Neutral Citation No. 2024 DHC 1115), wherein the Court has observed as follows:- “22. That apart, the factum that whether it is a case of ‘false promise’ or ‘breach of promise’ on part of the petitioner does not require any custodial interrogation as it is a matter to be decided at the stage of trial. Further, it is also not the case of the prosecution that the petitioner has any criminal record. On the contrary, the petitioner is stated to have recently graduated from the Delhi University and sending him to jail will affect his career which is yet to begin. No threat perception has been alleged by the State. 23. In any case, appropriate conditions can be imposed to ensure the availability of the petitioner to face the trial and to prevent him from influencing the witnesses in any manner.” 6. Reference is also made to Sumit Versus State Nct Of Delhi wherein Digitally Signed By:ROHIT KUMAR PATEL Signing Date:08.10.2026 11:17:58 Signature Not Verified BAIL APPLN. 3313/2026 Page 4 of 6 this Court granted anticipatory bail to the applicant therein by inter-alia placing reliance on Shane Haider (supra).
