THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.13913 of 2023 ORDER:-
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…issue writ, order more particularly in the nature of writ of mandamus by declaring the action of respondent no.2 and 3 in crediting the amount of Rs.17,83,990/- (Rupees Seventeen Lakhs eighty three thousand nine hundred and ninety only) into the savings account of petitioner in Acc.No.30868821405, State Bank of India, chilamthur branch, Ananthapur district in purusance to the public notice under section 3G of National Highways Act,1956 for the purpose of acquiring land to lay four/Six laning of newly proposed Banglore-Mydakuru (Kadapa) - Amaravathi (vijayawada Greenfield Expressway) for petitioner land an extent of Ac.0.74 cents in Sy.No.15-5B and Ac.2.83 cents in Sy.No.19-2 situated at Chagaleru Village, Chilamathur Mandal, Anathapur district, Presently named as Sri Satya Sai District without giving any oppurtunity to the petitioner as illegal, arbitrary, unconstitutional and in violation of Article 14, 21, 300-A of our Indian constitution and violation of principals of natural justice also in violation of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and National Highways Act,1956 and consequently direct the respondents to scruplosly follow the procedure laid down in The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and National Highways Act,1956 by respondent no.2 and 3 and determine compensation to the petitioner land an extent of Ac.0.74 cents in Sy.No.15-5B and Ac.2.83 cents in Sy.No.19-2 situated at Chagaleru Village, Chilamathur Mandal, Sri Satya sai district and to pass…”
2. The grievance of the petitioner in the writ petition is that the respondents 2 & 3, without following the due procedure of law as mandated under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 & National Highways Act, 1956, have credited an amount of Rs.17,83,990/- to the p. 5 petitioner’s account in respect of land to an extent of Ac.0.74 cents in Sy.No.15-5B and Ac.2.83 cents in Sy.No.19-2 situated in Chagaleru Village, Chilamathur Mandal, Ananthapur District, for the purpose of laying a highway.
Thus, the petitioner seeks a direction to the respondent authorities to scrupulously follow the procedure as provided under aforesaid Acts. 3. As seen from the material available on record, the respondents have already paid compensation to the claimant/writ petitioner. If the amount determined by the respondent authorities is not acceptable, an alternative remedy is available to the petitioner to file an appeal as provided under Section 3G(5) of the National Highways Act, 1956 (hereinafter referred to as ‘the Act’). 4. In view of the above, without going into merits of the case, the present Writ Petition is disposed of, granting liberty to the petitioner to file an appeal under 3G(5) of the Act. On filing of such appeal, the Arbitrator is directed to dispose of the appeal, within a period of two (02) months from the date of receipt of a copy of this order, strictly as per law. The status-quo granted by this Court on 08.12.2025, stands vacated. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. ___________________________________ JUSTICE TARLADA RAJASEKHAR RAO Date: 05.01.2026 TVN p. 6 82
