JUSTICE ANUROOP SINGHI Order 13/02/2026 1. Mr. V.D. Gathala, learned Assistant Government Counsel, puts in appearance on behalf of all the respondents. Hence, service is complete. 2. The present petition has been filed assailing the notices issued under Section 91 of the Rajasthan Land Revenue Act, 1956 (hereinafter referred to as “the Act of 1956”) to the petitioners, who are as many as 181 in number. 3. Learned counsel for the petitioners submits that the petitioners are in possession of the said land since more than past 40-50 years and have even enclosed the electricity connection granted to few of them. 4. Mr. V.D. Gathala, learned AGC, vehemently submits that the entire exercise is being done to remove the encroachment in pursuance to the repeated orders passed by National Green Tribunal and thus, the petitioners are required to submit their response to the notice issued to them under Section 91 of the Act of 1956. Considering the fact that the present petition has been filed assailing the notices issued under Section 91 of the Act of 1956, this Court is not inclined to entertain the writ petition and delve into the merits of the matter. 6. However, the petitioners are granted liberty to file reply to the notices within a period of 10 days from today, i.e. 13.02.2026 along with the documents on which they wish to rely upon to substantiate their right/title over the land mentioned in their respective notices. In the event of any such reply being filed by the petitioners, the respondent No.2 shall consider the reply of the petitioners alongwith the annexed documents and take a decision thereon within a period of two weeks from the date of filing of the reply, after granting due opportunity of hearing to the petitioners, strictly in accordance with law, by passing reasoned and speaking orders. Any order passed by the respondents in pursuance of the directions contained herein, shall be duly served upon the respective petitioner, within a period of three days from the date of passing such order. Considering the fact that there exist residential houses and the petitioners are residing there since last 40-50 years, as stated by the learned counsel for the petitioners, no coercive action be taken against the petitioners in pursuance to notices issued under Section 91 of the Act of 1956, and any action in pursuance of the said decision by the respondents would be initiated only after a period of ten days from the date of receipt of service of the said [2026:RJ-JP:6937] (9 of 9) [CW-1668/2026] decision/order upon the respective petitioner, enabling them to take appropriate legal remedies, if needed. 7. With the abovesaid directions, the writ petition stands disposed of. 8. Pending application(s), if any, stands disposed of. 9. Needless to say that the directions in this order have been issued only to take appropriate decision in the proceedings initiated under Section 91 of the Act of 1956, and in no manner is to be construed as a direction to take decision in a particular manner.
