THIS PETITION, COMING ON FOR PRELIMINARY HEARING (FRESH MATTERS LIST) THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioners are before this Court seeking for the following reliefs: a. Issue a writ in the nature of Mandamus directing Respondent Nos.3 and 4 to register an FIR based on the complaint dated 22/11/2025 submitted by the petitioner in respect of the death of Adarsh V vide UDR No.47/2025 dated 22.12.2025 vide ANNEXURE - A AND A1; b. Direct that investigation be entrusted to an independent agency or superior officer to ensure fair and impartial investigation; c. Direct the disciplinary authority or the investigating agency (CBI) to take necessary action against the erring officials; - 3 - HC-KAR NC: 2026:KHC:28120 WP No. 9202 of 2026 d. Pass such other order(s) as this Hon'ble Court deems fit in the interest of justice and equity. 2. The grievance of the petitioner is that a UDR has been issued in respect to the death of one Sri.Adarsh.V on the ground that he has committed suicide. The petitioner No.1 is the father and petitioner No.2 is the brother of the deceased, who have brought to the notice of the respondents that there was a conspiracy to commit the murder of the deceased and had even provided the details of the suspected persons clearly stating that it is a case of homicide and not a suicide. Despite which an UDR came to be issued without investigation, it is in that background that the petitioner is before this Court seeking for aforesaid reliefs. 3. A perusal of the papers indicates that the first information was received on 22.12.2025 at 06.00 p.m. and UDR No.47 of 2025 was issued on the very same day at 06.30 p.m. within 30 minutes. The same does not inspire any confidence inasmuch as there is no particular verification of the facts which could have been done within 30 minutes for issuance of the UDR. 4. A perusal of the photographs indicates that the deceased is supposed to have hung himself, which is - 4 - HC-KAR NC: 2026:KHC:28120 WP No. 9202 of 2026 ex-facie highly improbable, since the height of the roof is probably around 6.5 feet and in the opinion of this Court, no adult can hang himself from that height. 5. Ex-facie, it is clear that the jurisdictional SHO has not even verified the details resulting in an improper UDR having been issued and investigation in a serious offence like death not even carried out. The same is much more than dereliction of duties. 6. Respondents No.1 and 2 are directed to look into this aspect and initiate such enquiry as may be necessary against these actions of respondent No.4. As such, this Court passes the following; ORDER i. The writ petition is allowed. ii. Respondent No.4 is directed to register FIR based on the complaint submitted by the petitioner on 22.11.2025, investigate the said complaint in a proper manner in accordance with law and submit the final report.
