JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in C.C.No.410/2023, pending before the IV Addl. Civil Judge and JMFC, Hassan, for the offences punishable under Sections 498(A), 323, 324, 342, 504, 506, 114, 354 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. - 3 - HC-KAR NC: 2026:KHC:28052 CRL.P No. 6449 of 2026 2. Heard Sri.Prasanna D.P, learned counsel appearing for the petitioners, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.G.Jairaj, learned counsel appearing for respondent No.2 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.6822/2023 and have settled the dispute amongst themselves before the Mediation Center, by terms of settlement. One of the term of the settlement is, closure of the present proceedings. The Joint Memo filed by parties to the lis reads as follows: “The Petitioners and Respondent No.2 above named submitted as follows:- 1. The marriage of the 1st Petitioner was solemnised at Hassan and they led their marital life for short period, however the 2nd respondent has deserted the 1st Petitioner and started living with her mother House at Bengaluru and 1st Petitioner has filed a petition before the family court at Hassan for the dissolution of their marriage, the 2nd respondent has filed a petition before the Magistrate court at Bengaluru under domestic violence and also filed a Criminal Case against the 1st Petitioner and their family members in Cr.No.47/2022 and 1st Respondent has filed a Charge sheet against the Petitioners for the offence U/S 498(A), 323, 324, 342, 504, 506, 114 R/w 34 of IPC and 3 and 4 of D.P act - 4 - HC-KAR NC: 2026:KHC:28052 CRL.P No. 6449 of 2026 same is pending before the IV Addl., Civil Judge and JMFC Hassan in C.C.No.410/2023, in the meantime the matrimonial case is transferred from Hassan to Bengaluru same is pending before the I Addl., Family court at Bengaluru in M.C. No.6822/2023 and same is referred for mediation and both the parties have settled the disputes between the parties before the Bengaluru Medication Center, thereby the 2nd respondent has consented for dissolution of the marriage and to withdraw all the cases filed against the Petitioners and 1st Petitioner has agreed to pay permanent alimony of Rs. 12,00,000/- to the 2nd respondent and they have exchanged all the articles and 1st Petitioner has furnished the copy of the DD and agreed to hand over the same before the Family court at the time of reporting the same on 25.04.2026. 2. It is submitted that, due to personal inconvenience parties have not appeared before the family court at Bengaluru for reporting settlement, as such the matter is posted to 16.06.2026. In the meantime, the petitioners have filed the above petition for quashing the criminal case pending against them and now the petitioners have handing over the original DD's for a sum of Rs. 12,00,000/- to the 2nd respondent before this Hon'ble Court today and 2nd respondent has no objection to quash the criminal proceeding in C.C. No.410/2023 on the file 4th Addl., Civil Judge and JMFC at Hassan by allowing this petition. And the 2nd respondent herewith undertake to appear before the family court for reporting settlement for Divorce and also agreed to withdraw the Crl. Misc. No. 182/2022 and Crl. Misc. No.72/2025 on the file of MMTC-2 at Bengaluru. Wherefore the Petitioners and the Second Respondent prays that this Hon'ble Court be pleased to quash the proceedings in CC No.410/2023, now pending before the 4th Addl., Civil Judge and JMFC at Hassan in the interest of Justice.” 4. Therefore, in light of the settlement arrived at between the parties quoted supra and the offences not being against the State, I deem it appropriate to accept the Joint Memo and terminate the proceedings pending against these petitioners in the subject petition. 6. The petitioners hands over demand draft of Rs.12,00,000/- and the same is acknowledged by the complainant who is present before the Court. 7. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.410/2023, pending before the IV Addl. Civil Judge and JMFC, Hassan, stands quashed, qua the petitioners.
