[2026:RJ-JP:3471] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 17160/2025 Amarchand @ Radhe S/o Babulal, R/o Madhopur, Mohalla Richwana (Richhwa) Police Station Aklera, District Jhalawar, At present Kevchi Road, Aklera Jhalawar (Accused presently confined at District Jail Byawar) ----Petitioner Versus State of Rajasthan through P.P. ----Respondent For Petitioner(s) : Mr. Bhim Singh Meena For Respondent(s) : Mr. Amit Punia, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 27/01/2026 1. This bail application under Section 483 of BNSS has been filed on behalf of the petitioner, who has been arrested in connection with FIR No.745/2023 registered at Police Station Beawar City, District Beawar for offences punishable under Sections 489B and 489C of IPC. During the course of investigation, offences punishable under Sections 489D, 201 & 120B of IPC have also been added against the petitioner. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that petitioner has been made accused in this case solely on the basis of police interrogation of co-accused. Counsel submits that neither petitioner is named in the FIR nor any fake currency-note is recovered from the possession of the [2026:RJ-JP:3471] (2 of 3) [CRLMB-17160/2025] petitioner. Counsel submits that co-accused namely- Shivlal, Shakur Mohammed, Sanjay, Rahul Matwa, Sharwani @ Saniya, Deepak & Surendra Singh have already been granted benefit of bail by this Court. Counsel submits that charge-sheet has been filed in this matter. It is submitted that trial will take considerable time in its conclusion. Counsel contends that petitioner is in custody since 06.10.2025 and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the bail application. He submits that petitioner is habitual offender as three other cases of similar nature have been registered against him. 4. At this stage, learned counsel for the petitioner submits that in one case, petitioner has already been granted benefit of bail by the co-ordinate Bench of this Court vide order dated 16.01.2026. 5. I have considered the contentions. 6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, especially the fact that no recovery of the fake currency-notes has been made from the possession of the petitioner; aforementioned co-accused persons have already been granted benefit of bail by this Court; charge-sheet has been filed in this matter as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 7. The bail application is accordingly allowed and it is directed that accused-petitioner- Amarchand @ Radhe S/o Babulal shall be released on bail provided he furnishes a personal bond in the [2026:RJ-JP:3471] (3 of 3) [CRLMB-17160/2025] sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 8. However, it is made clear that the petitioner shall not involve in similar offence(s) during currency of bail granted by this Court. 9. If breach of this condition is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to petitioner by this Court. 10. Office is directed to send copy of this order to the concerned SHO for necessary compliance. 11. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /16
