KONDAGUNTA VILLAGE, GUDUR MANDAL, TIRUPATI (ERSTWHILE SPSR 2 Dr. YLR, J W.P.No.12524 of 2026 Dated 05.05.2026 NELLORE) DISTRICT - 524101 ...RESPONDENT(S): Counsel for the Petitioner: PATHI SIVA PRASAD Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue an appropriate Writ more particularly in the nature of WRIT OF MANDAMUS declaring the inaction of the respondents more particularly respondent No 6 in failing to provide police aid to me and my agricultural land an extent of Ac.2.50 Cents is situated in Survey No 236-1A4B (LP.No.342) of Kondagunta Village Gudur Mandal Tirupati District despite the orders passed by this Honble Court in W.P.No.3038 of 2026 dated 05.03.2026 even after submitting written representations dated 13 .02. 2026 and 13. 04. 2026 before the respondent police seeking police protection but no action has been initiated which is highly illegal arbitrary and against the principles of Natural Justice besides being a violation of Articles 14 21 and 300A of the Constitution of India and consequently direct the respondent no 6 to implement the orders passed in W P No. 3038 of 2026 dated 05. 03. 2026 by this Honble Court and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Mr. Pathi Siva Prasad, learned counsel for the petitioner, submits that respondent No.6 failed to provide police aid to the petitioner in respect of the agricultural land admeasuring Ac.2.50 cents situated in Survey No.236- 3 Dr. YLR, J W.P.No.12524 of 2026 Dated 05.05.2026 1A4B (LP.No.342) of Kondagunta Village, Gudur Mandal, Tirupati District, despite the orders passed by this Hon’ble Court in W.P.No.3038 of 2026 dated 05.03.2026. He further submits that, even after submitting written representations dated 13.02.2026 and 13.04.2026 before the respondent police seeking police protection, no action has been initiated. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the petitioner had earlier filed W.P.No.3038 of 2026, wherein this Court granted an order of status quo with respect to the subject land pending further orders. It is submitted that the said order does not contain any specific direction to the respondent police to provide police protection to the petitioner. The learned Assistant Government Pleader further submits that, in the absence of any specific direction from the competent Court, the police have no role to play in the matter. However, it is submitted that if the petitioner approaches the respondent police with any specific protection order issued by a competent authority, the police are ready to act in accordance with law. 5. Be that as it may, when the petitioner submits representations to the respondent police, it is the duty of the respondent police to dispose of the same in accordance with law. 6. Having regard to the entire facts and circumstances of the case, and recording the submissions made by the learned Assistant Government Pleader, the Writ Petition is disposed of directing the respondent police to 4 Dr. YLR, J W.P.No.12524 of 2026 Dated 05.05.2026 dispose of the representations dated 13.02.2026 and 13.04.2026 submitted by the petitioner, in accordance with law, within a period of three (03) weeks from the date of receipt of the copy of this order. 7. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
