Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He
[2026:RJ-JP:2220] (2 of 3) [CRLMB-15/2026] further submits that prima-facie offence under Section 110 of BNS is not made out against the petitioners. There is only a single head injury caused to the injured Babulal which was found to be a hairline fracture and not sufficient to cause death and not intended or caused with the knowledge that death would be the result. The accused-petitioners are in custody since long, charge-sheet has already been submitted and trial of the case may take considerable time, therefore, the bail application of the accused- petitioners may be allowed.
3. Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed the bail application.
4. Heard and perused the material available on record.
5. Considering the fact that apart from a single injury caused to the injured on his head, there are no other injuries which are opined to be dangerous to life or may cause death, therefore, considering the aforesaid facts and without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely: 1. Ishwar @ Susu S/o Rohitash, 2.
