State Of Rajasthan Through Tehsildar, Sanganer District Jaipur ----Respondents For Petitioner(s) : Mr. Ashwani Bhargav For Respondent(s) : HON'BLE MR. JUSTICE BIPIN GUPTA Judgment / Order 06/01/2026 1. The present writ petition has been filed assailing the order dated 24.11.2025 passed by learned Additional Civil Judge No.18, Jaipur Metropolitan-I (Headquarter Sanganer) whereby the application for recalling the order dated 10.09.2025 has been [2026:RJ-JP:35] (2 of 2) [CW-20643/2025] rejected and the opportunity to cross-examine DW1-Rajendra Singh was declined. 2. It is contended by learned counsel for the petitioner that due to the health condition of the DW1-Rajendra Singh, he could not appear for completion of his cross-examination after partial cross- examination. He, therefore, prays that one opportunity, in the interest of justice, may be granted to complete the cross- examination. 3. Considering the same, this Court finds it appropriate to grant one last opportunity to the petitioner witness DW1-Rajendra Singh to appear before the learned Trial Court on the next date of hearing and get his cross-examination completed, subject to payment of cost of Rs.25,000/-. The cost shall be paid to the plaintiff-respondents. No further opportunity shall be granted to the petitioner. 4. Learned Trial Court is also directed to decide the suit as expeditiously as possible. Further, if the respondents are aggrieved in any manner by this order, then they are at liberty to file an application to recall the order. 5. With the above observations, the present Civil Writ Petition stands disposed of. 6. All pending application(s) also stand disposed of. (BIPIN GUPTA),J MAHIMA/3
