Also heard Shri Priyank Rathi, learned Government Advocate appearing for the respondent/State. 1. Petitioner has filed the present petition for the following reliefs: “10.1 The Hon’ble Court may be pleased to issue a writ of mandamus commanding Respondent nos.2 to 4 to initiate action /investigation on the complaint lodged by the petitioner accordance with the provision of S.173 of the B.N.S.S. 10.2 The Hon’ble Court may be pleased to issue a writ of mandamus commanding Respondent nos.2 to 4 to provide security to the petitioner as he is protected with the Right of Article 21 of the Constitution of India. 10.3 Any other relief, which this Hon’ble Court may deem fit and proper, looking to the facts and circumstances of the case, may also be awarded to the Petitioner including the cost and expenses of this petition.” 2. Learned counsel appearing for the petitioner would submit that despite several complaints/representations made by the petitioner, respondent authorities have not taken any action on the complaint made by the petitioner. He would also submit that private respondent-5 has been granted anticipatory bail on 27.06.2025 by this Court in MCRCA- Wpcr 88 of 2026 3 794 of 2025. 3. Learned State counsel, on the other hand, has submitted that the grievance of the petitioner can be very well redressed before the Court below by filing an application under Section 156 (3) Cr.P.C. He further submits that the controversy involved in the present matter has already been decided by the High Court of Allahabad in Misc. Bench No. 24492 of 2020 : Waseem Haider Vs. State of U.P. Through Principal Secretary, Home Others vide judgment and order dated 14.12.2020 as well as by this Court in WPCR No.333 of 2020 (Akhilesh Agrawal v. State of Chhattisgarh & Others) decided on 12.04.2023, dismissing the said petition, hence, the present petition be also dismissed in terms of the said order. 4. Accordingly, the present writ petition is dismissed with liberty to the petitioner to avail the appropriate remedy before appropriate Forum.
