Order 21/01/2026
1. The instant fifth bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused- petitioner has been arrested in connection with FIR No.67/2024, registered at Police Station Viratnagar, District Kotputli-Behror for the offences under Sections 8/21, 8/22 and the N.D.P.S. Act.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in the present case. It is alleged against the petitioner that Proxywel Spas capsules were recovered from his possession. It is contended that the composition of Proxywel Spas capsules does not contain Tramadol Hydrochloride, rather, the said capsules contain only Dicyclomine and Paracetamol. It is further contended that there is every possibility that the petitioner has been falsely implicated and the samples sent to the FSL were tampered. The accused-petitioner is
[2026:RJ-JP:2570] (2 of 2) [CRLMB-17138/2025] in custody since long and the trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the grant of bail application and submitted the FSL report.
4. Heard and perused the material available on record.
5. The FSL report reveals that the samples sent for analysis were found to contain Tramadol along with Dicyclomine and Paracetamol and whether the samples were tampered with or not is a question to be decided during the course of trial. The earlier bail application of the accused-petitioner was dismissed on merits, the quantity recovered from the petitioner's possession falls within the ambit of commercial quantity and the rigors of Section 37 of the N.D.P.S. Act are attracted, therefore, considering the aforesaid
facts and without commenting anything on the merits of the case, this Court is not inclined to enlarged the accused-petitioner on bail.
6. Accordingly, the instant fifth bail application filed by the accused-petitioner is hereby dismissed.
