Order 28/01/2026
1. Without pressing the present writ petition on merits, learned counsel for the petitioner submits that the basis of the suit is a document which is in possession of the Court, before which the criminal proceedings are going on. He, therefore, prays that he may be given liberty to obtain certified copy of the document from
[2026:RJ-JP:3750] (2 of 2) [CW-557/2026] the Court and place the same before the learned Civil Court in which the suit is pending.
2. Accordingly, the present writ petition is dismissed as withdrawn. However, the petitioner would be at liberty to obtain and submit the said document before the learned Civil Court along with an application under Order 7 Rule 14 CPC. It is made clear that if the said application is filed, the learned trial Court is ex- pected to decide as expeditiously as possible, in accordance with law.
3. With the above observations, the present writ petition stands
disposed of.
4. Pending application(s), if any, also stands disposed of.
