THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The Petitioner is before this Court seeking for the following reliefs: a. Issue a writ of Mandamus or any other appropriate writ, order or direction directing the Respondents to consider and dispose of the Petitioner's representations dated 09.06.2026 seeking permission for conducting the annual Moharam Festival forthwith and within a time frame fixed by this Hon'ble Court; Vide Annexure D and D1; b. Issue a writ of Mandamus directing the Respondents that the Petitioner submits a fresh representation for conducting the annual Moharam Festival in future years, the same shall be considered and appropriate orders shall be passed within a stipulated period, within a time frame fixed by this Hon'ble Court; c. Direct the Respondents not to unnecessarily delay consideration of the Petitioner's applications for permission relating to the annual Moharam Festival and connected religious activities; d. Issue any other order or direction as this Hon'ble Court deems fit and proper under the facts and circumstances of this case to meet the ends of Justice. - 3 - HC-KAR NC: 2026:KHC:29307 WP No. 18039 of 2026 2. The grievance of the petitioner is that the representation / application submitted by the Petitioner on 09.06.2026 seeking for conducting the annual Moharam festival with police protection has not been granted as done in the earlier years. 3. A perusal of Annexure-C4 indicates that the Petitioner has been granted permission and protection for the year 2023. If similar permission and protection had been granted for the year 2024-25, the Respondents are directed to consider the application submitted by the Petitioner favourably and grant permission and protection as granted in previous years. 4. Since the submission is that the festival commences from today i.e., 16.06.2026, necessary orders to be passed by Respondents by 17.06.2026. 5.
