The State of West Bengal & Ors. Md. Raziuddin …..for the appellant 1) We do not find any reason to interfere with the order of Her Lordship. 2) The allegation of the appellant before the concerned Gram Panchayat was that, a private party was raising a construction which was blocking the egress and ingress of the appellant and such construction was without maintaining the building norms. 3) Her Lordship found that, the issue of blocking the egress and ingress is a civil dispute, which has to be decided by the Civil Court. 4) We do not find that any allegation had been made that the construction of the private party was without any sanction or permission or that the construction was on a government land or land belonging to the panchayat authority. 5) Under such circumstances, we dismiss the appeal and application without any interference. Appellant can always approach the appropriate authority with his grievance at
the appropriate stage, but the writ petition was rightly decided. 6) Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Shampa Sarkar, J.) (Ajay Kumar Gupta, J.) 2
