Heard learned counsel for the Petitioner and learned Counsel for the State. Perused the Anticipatory Bail Application as well as the F.I.R. 3. This is an application under Section 482 of the BNSS filed by the Petitioner for anticipatory bail, involving offence punishable under Sections 106(1), 288, 125 & 3(5) of the BNS in connection with Nihalprasad P.S. Case No.120 of 2026 pending in the Court of learned J.M.F.C., Gondia. 4. It is stated by Mr. Rath, learned Senior counsel for the Petitioner that all the offences are bailable in nature. He further Page 2 of 2. contended that one of the co-accused has already been extended with the benefits under Section 35 of the BNSS. In view of the aforesaid position, this Court is of the view that the present anticipatory bail application is not maintainable as there is no apprehension of arrest. 5. Accordingly, the present anticipatory bail application is disposed of by granting liberty to the Petitioner to approach this Court again in the event any higher offence is added at the time of filing of the chargesheet. 6.
