Page No.# 2/3 BEFORE HON'BLE MR. JUSTICE DEVASHIS BARUAH O R D E R 23.03.2026 Heard Ms. Nancy Lotha, learned counsel appearing on behalf of the Petitioner and Mr. E. Thiba Phom, learned Government Advocate who appears on behalf of the Respondent Nos. 1, 3 and 5. 2. Taking into account the issue involved herein, this Court takes up the writ petition for disposal at the stage of motion. 3. The Petitioner herein had filed an application under the Right to Information Act, 2005 on 13.05.2025 seeking a copy of the notice inviting tender published in the Local Dailies as well as National Dailies for the establishment of the College of Nursing co-related with College (NMISR) construction of Administrative Block at NIMSR, Kohima. The Petitioner did not receive any information which led the Petitioner to file another application on 19.06.2025 seeking the same information. As the Petitioner then also did not receive any information, the Petitioner filed the first appeal. Further to that, as information was not provided the Petitioner filed a Second Appeal before the Nagaland Information Commission. Vide Order dated 18.02.2026, after noting down the facts, the Nagaland Information Commission disposed of the said appeal observing that a copy of the NIT and the photograph of the said NIT displayed in the Department’s Notice Board had already been furnished to the Petitioner and the sufficient explanation and clarification regarding the NIT was

The Petitioner, however, is aggrieved by the fact that the query which the Petitioner sought for as to whether the Notice inviting tender was advertised in the Local Dailies as well as the National Dailies have not been answered by the concerned Respondent Authorities. 5. This Court has duly taken note of the applications which were filed on 13.05.2025 and 19.06.2025 by the Petitioner and from the said it appears that the Petitioner only sought for the Notice Inviting Tender published in the Local/National Dailies for establishment of the College of Nursing co- related with College (NMISR) construction of Administrative Block at NIMSR, Kohima and in that regard the Respondent Authorities have provided a copy of the Notice inviting tender as well as the photograph of the Notice Inviting Tender published in the Department Notice Board. 6. Taking into account the information which the Petitioner had sought for and what has already been provided to the Petitioner, this Court is not inclined to exercise its jurisdiction under Article 226 of the Constitution. Accordingly, the instant writ petition, therefore, stands dismissed. 7. Be that as it may, before parting with the record this Court observes that the dismissal of the writ petition shall not preclude the Petitioner to seek information specifically on the question as to whether the Notice inviting tender which was displayed in the Department’s Notice Board was published in the Local Dailies as well as the National Dailies, if so advised.
