1. Heard. 2. The petitioner, which is a society registered as per the provisions of the Chhattisgarh Society Registration Act, 1973 has filed this writ petition seeking a direction from this Court to the respondents to give pensionary benefits to its members and all retired government servants of State of Chhattisgarh with effect from 01.01.1996 within a prescribed period. 3. The return/reply has been filed by the State/respondents. It is submitted by the learned State/respondents that the relief which the petitioner is seeking in DEEPTI JHA Digitally signed by DEEPTI JHA
2 this writ petition has already been considered by the respondents and the grievances has been redressed, for which the pending arrears of the petitioner association were made. A return filed by the State/respondent is necessary to be quoted below:-
“2. That, answering respondents/State humbly and respectfully submit that, during pendency of the instant petition, the respondent authorities revised the pension of the pensioners as per the circulars issued by the Finance Department, Government of Chhattisgarh from time to time. The claim of the petitioner with regard to grant arrears and other applicable retiral dues, was considered with respect to the pensioners retired prior to 01.01.1996 and extended the said benefits to them. It is submitted that the pension of the petitioners retired prior to 01.01.1996, has been revised according to the Pension Salary Revision Rules, 2017 and paid the amounts to the pensioners. In this regard, copy of the relevant documents and certificate issued by the concerned Bank are collectively filed and marked herewith ANNEXURE R/1 for kind perusal of the Hon'ble as Court.”
4. The documents have also been filed along with return to support the pleadings in paragraph 2. 5.
In view of the above, this writ petition is disposed of at this stage. A copy of this order be sent to the petitioner association, who would be at liberty to file a fresh writ petition in case any cause of action still subsists or eventuality arises. 6. Interlocutory application(s), pending if any, also stands disposed of. Sd/-
