JUSTICE PRAVEER BHATNAGAR
Order 06/01/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The accused-petitioners have been arrested in connection with FIR No. 179/2025 registered at Police Station Sarund, District Kotputli-Behror for the offences under Sections 316(3) and 318(4).
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the name of the petitioners did not appear in the FIR. The petitioners were not the driver of the vehicle bearing No.RJ 32 GC 1718 and not committed any misappropriation of the goods. The allegation of misappropriating the goods are against the drivers of other vehicles. No recovery of any misappropriated goods were effected from the petitioners's possession and the FIR
[2026:RJ-JP:122] (2 of 3) [CRLMB-17165/2025] is also delayed. It is also contended that the co-accused Waris Khan who was named in the FIR, was the driver of the another vehicle, has already been enlarged on bail and the petitioners's case is on better footing than the case of the co-accused Waris Khan. The petitioners are in custody since 22.10.2025 and the offence is exclusively triable by Magistrate. The trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the petitioners along with the other co-accused misappropriated the goods handed over to them. The misappropriated goods was of Rs.70,00,000/-, therefore, considering the gravity of the offence, the bail application of the accused-petitioners may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case. Considering the fact that the petitioners are in custody since 22.10.2025 and the matter is exclusively triable by Magistrate, I deem it just and proper to enlarge the accused-petitioners on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely: 1. Amarsingh S/o Choturam and 2. Jyoti Prakash S/o Mishrilal, in connection with FIR No. 179/2025 registered at Police Station Sarund, District Kotputli-Behror, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before
[2026:RJ-JP:122] (3 of 3) [CRLMB-17165/2025] the court concerned on all the dates of hearing and as and when called upon to do so.
