[2026:RJ-JP:1612] (2 of 3) [CW-219/2026]
1. The present writ petition has been filed against the order dated 14.11.2025 passed by the Appellate Tribunal, Jaipur Development Authority, whereby the stay application filed by the petitioners in appeal bearing No.1041/2025 for grant of an ad interim stay has been declined.
2.
Learned counsel for the petitioners submits that the petitioners No. 3 to 6 are recorded Khatedars of the land as mentioned in Annexure-4 which includes Khasra No.194 and he further submits that the land of the petitioners is being included or taken away for development of some other scheme without any acquisition proceedings which is violative of Article 300-A of the Constitution of India, therefore, till the disposal of the Appeal No. 1041/2025 titled Govind Prasad Manglunia & Ors. Vs. Jaipur Development Authority, the land of the petitioners, may not be included and taken away.
3.
Learned counsel for the respondent No.2, upon instruction of their client, submits that to avoid further delay in the matter, the pending appeal, which is fixed for hearing on 03.02.2026, is being decided in a time bound manner and he has no objection if, during that limited period, the land of the petitioners is not included. He also submits that this concession may not be taken as admission of the respondent while adjudicating the appeal on merits.
4.
Learned counsel for respondent No.1-JDA submits that they will also place all arguments before the Appellate Tribunal, Jaipur Development Authority, in that respect.
5. Heard learned counsels for both parties and perused the record.
