Criminal Miscellaneous Bail Application No. 17190/2025 Sukarmpal S/o Subhashchandra, Aged About 50 Years, R/o Mandola, P.S. Satnali, Mahendragarh (Haryana) (At Present In J.C. At District Jail Jhunjhunu) ----Petitioner Versus State of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Majhar Hussain with Ms. Soniya Saini & Mr. Wasim Akram For Respondent(s) : Mr. Amit Punia, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 12/01/2026 1. This bail application under Section 483 of BNSS has been filed on behalf of the petitioner, who has been arrested in connection with FIR No.64/2024-25 registered at Police Station Excise Prevention Team, District Jhunjhunu for offences under Sections 14/54, 19/54 & 54(A) of Rajasthan Excise Act, 1950. The investigation against the petitioner is being conducted only for offence punishable under Section 54(A) of the Excise Act. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Learned counsel submits that alleged offences are triable by Magistrate. Counsel submits that petitioner has been made accused solely on the basis of the fact that vehicle in which the co- accused namely- Bhanwraram was carrying the illicit liquor, was [2026:RJ-JP:1049] (2 of 3) [CRLMB-17190/2025] registered in the name of the petitioner. Counsel submits that said co-accused has already been granted benefit of bail by this Court. It is submitted that petitioner has no criminal antecedents and trial will take considerable time in its conclusion. Petitioner is in custody since since 12.12.2025. Further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the bail application. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, as also the fact that alleged offences are triable by Magistrate; co-accused who was found in possession of illicit liquor, has already been granted benefit of bail; there are no criminal antecedents of the petitioner and trial will take considerable time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. The bail application is accordingly allowed and it is directed that accused-petitioner- Sukarmpal S/o Subhashchandra shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. [2026:RJ-JP:1049] (3 of 3) [CRLMB-17190/2025] 7. The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /17
