Petitioner seeks regular bail in a case registered for the offence punishable under Sections 310(4), 310(5) and 3(5) of the B.N.S., Sections 25(1-B)a, 26 and 35 of the Arms Act and Sections 30(a) and 37 of the Bihar Prohibition and Excise Act. 3. As prosecution case, four liters illicit country made liquor and illegal arms and ammunition were recovered from possession of co-accused Kumar Gautam @ Tittu who disclosed the name of this petitioner as one of his associate. 4. Learned counsel appearing for the petitioner submits that petitioner is quite innocent and has committed no

No incriminating article has been recovered from conscious possession of this petitioner and has falsely been implicated in this case merely on the basis of confessional statement of co-accused Kumar Gautam. Save and except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged offence. It si further submitted that co-accused Kumar Gautam has already been granted bail by this Hon’ble Court vide order dated 08.08.2025 passed in Cr. Misc. No. 35424 of 2025. Moreover, charge-sheet has already been submitted and petitioner is in custody since 02.12.2025. 5. Learned A.P.P. for the State the prayer for bail to the petitioner. 6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, fact that no incriminating article has been recovered from possession of this petitioner and period of custody, the prayer for grant of bail to the petitioner is allowed. 7. Accordingly, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Patna
