By way of the present application, the applicant seeks grant of interim bail on medical grounds in connection with FIR No. 349/2020, registered at Police Station Krishna Nagar, District Shahdara, Delhi, under Section 365 of the Indian Penal Code, 1860. 2. Pursuant to the order dated 07.04.2026, a medical status report dated 10.04.2026 has been furnished by the Senior Medical Officer, Central Jail No. 13, Mandoli, Delhi, which has been handed over in Court and is taken on record. 3. The relevant extracts of the report read as under: “Submission of medical status report of patient/inmate Neeraj S/o Udaiveer (age/38yr). In reference to communication received in the office of the undersigned from Hon'ble Court regarding medical status report of inmate Neeraj S/o Udaiveer following points may be noted. 1. He is currently lodged in Central Jail No 13. He is a follow- up case of left sided L-5 lumber disc Radiculopathy This is a digitally signed order. Inmate was last reviewed at GTBH, neurosurgery dept. on 09.03.2026, where neurosurgeon (specialist doctor) examined him and advised medications and physiotherapy, repeat MRI spine and X-Ray. And also patient last visited at LNJP Hospital on 01.04.2026 for MRI date, The on duty doctor has given MRI date on 27.04.2026 which is scheduled accordingly. Patient is also receiving high protein diet, walker support, LS belt, physiotherapy from jail hospital. This is for your kind perusal and onward submission. Enclosure: Copies of medical records and investigations” 4. A perusal of the aforesaid report indicates that the applicant is a follow-up case of left-sided L5 lumbar disc radiculopathy with prolapse of the L5-S1 intervertebral disc [“PIVD”], for which he had earlier been advised discectomy surgery; however, he declined the same and has since been undergoing conservative treatment, including medication and physiotherapy, at the Guru Teg Bahadur Hospital [“GTBH”]. At the time of his last review on 09.03.2026, he was further advised a repeat MRI of the spine alongwith an X-ray. The report also records that the MRI has been scheduled for 27.04.2026. 5. It appears from the status report that the applicant is presently receiving requisite medical care through the jail authorities. Having regard to the medical status report and the nature of treatment presently being extended to the applicant, I am not inclined to grant interim bail on medical grounds at this stage. 6. At this stage, Mr. Lakshay Joshi, learned counsel for the applicant, submits that the applicant is willing to reconsider undergoing the discectomy surgery, as earlier advised. The present application, alongwith the pending applications is, accordingly, disposed of. 8. Needless to state, it shall be open to the applicant to seek appropriate relief, in accordance with law, in the event of any emergent medical condition or other exigency.
