For the Respondents: Mr. Rahul Gathania, Advocate. ------------------------------------------------------------------------- Jyotsna Rewal Dua, Judge Petitioner seeks enforcement of Vijay Kumar versus Himachal Road Transport Corporation and another2 wherein following operative directions were issued:- “Notice. Mr. Jagmohan Sharma, Advocate vice Mr. Rahul Gathania, learned counsel, appears and waives service of notice on behalf of the respondents. 2. With the consent of learned counsel for the parties, the matter is heard at this stage. 3. Petitioner’s grievance is that his representation dated 02.01.2025 (Annexure P-5) seeking applicability of Himachal Road Transport Corporation Versus Lekh Ram Etc.3 has not been decided till date by the respondents/competent authority. Learned counsel for the petitioner submitted that the petitioner would be content in case the respondents/competent authority(s) are directed to consider and decide the aforesaid representation in accordance with law within a fixed- 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2CWP No.16306/2025, decided on 16.10.2025. 3Civil Appeal Nos.1557-1564 of 2019, decided by thye Hon’ble Apex Court on 08.02.2019. 2 time schedule. Learned counsel for the respondents is not averse to this prayer. 4. Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of with a direction to the respondents/ competent authority to consider and decide the aforesaid representation of the petitioner dated 02.01.2025 (Annexure P-5) in accordance with law as well as taking into consideration the above judgment in the case of Lekh Ram2 within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.” 2. Learned counsel for the respondents has placed on record office letter dated 26.08.2026 and on that basis submits that arrears due to the petitioner have been computed and first installment of aforesaid arrears has already been released to the petitioner; That for release of further installments, the respondents have worked out a schedule.
