JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 2 01-07-2026 Heard the parties. 2. The petitioners are named in the F.I.R. and apprehending their arrest in connection with Ramgarhchowk P.S. Case No.89/2026 registered for the offences punishable under Sections 115(2), 126(2), 109(1), 351(2), 352(2) and 3(5) of the BNSS. 3. The allegation against petitioners is to assault on the head of the informant by petitioner no. 1 by brick, where occurrence alleged to be arising out of family dispute/querral. 4. It is submitted by learned counsel appearing on behalf of the petitioners that allegation of physical assault as alleged against petitioner no. 1 not appears repeated and Patna High Court CR. MISC. No.41967 of 2026(2) dt.01-07-2026 2/2 moreover upon medical examination same found simple. It is submitted that allegation of assault not appears available against petitioner no. 2 and 3. All Petitioners claimed clean antecedent. 5. Learned APP opposes the prayer of bail. 6. In view of aforesaid factual submission and by taking note of fact as allegation to cause head injury is available only against petitioner no. 1 causing simple injury, who is a lady, coupled with the fact as allegation of assault not appears available against petitioner no. 2 and 3, accordingly all above- named three petitioners, in the event of their arrest or surrender before the court below within a period of four weeks, are directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned JM, 1st Class Lakhisarai/concerned Court, where the case is pending in connection with Ramgarhchowk P.S.
