Angami, learned Senior Government Advocate is present for the State respondent nos. 2 and 3 and learned counsel, Ms. Asi Kire appears on behalf of Mr. Yangerwati, learned CGSC. By Order dated 19.01.2026, this Court had directed the Registry to communicate to Shri Khape Koza, Rtd. District and Sessions Judge, Nagaland to ascertain his willingness to act as an arbitrator in the present dispute and to furnish the disclosure under Section 12(1) of the Arbitration and Conciliation Act, 1996. The Letter dated 09.02.2026 has been received from Mr. Khape Koza, Rtd. District and Sessions Judge, Nagaland expressing his willingness to be appointed an arbitrator in the case. He has also disclosed that he has no past or present relationship and neither any interest in any of the parties involved in this matter. Accordingly, this Court appoints Shri Khape Koza, Rtd. District and Sessions Judge, Nagaland as the sole Arbitrator to adjudicate the disputes between the parties. The learned Arbitrator shall enter upon reference and conduct the proceedings in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The fees and venue shall be decided by the Arbitrator in consultation Page No.# 3/3 with the parties. The Registry shall transmit the case records to the Arbitrator.
