JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.3 in Crime No. 54/2025 registered by V.V.Puram Police Station, Mysuru, for the offences punishable under Sections 417, 406, 420, 465, 467, 468 read with Section 34 of Indian Penal Code (hereinafter referred to as 'IPC' for short) is before this Court in this criminal petition filed under Section 438 of the Code of Criminal Procedure, seeking anticipatory bail.
2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent/State.
3. FIR in Crime No. 54/2025 was registered by V.V.Puram Police Station, Mysuru, for the aforesaid offences against Mahesha and others based on the first information dated 07.09.2025 received from Vasanth H S, who is the alleged victim in the present case.

HC-KAR NC: 2026:KHC:28792 CRL.P No. 15854 of 2025 Apprehending arrest in the present case, petitioner who is arraigned as accused No.3 in the FIR had filed Crl.Misc.No. 1482/2025 before the jurisdictional Sessions Court, which was rejected on 04.10.2025. Therefore, she is before this Court.
4. The material on record would go to show that petitioner is the owner of the property for which accused Nos. 1 and 2 had borrowed loan from complainant Bank for the purpose of purchase of the said property. According to the prosecution, petitioner had no marketable title for the said property. However, the fact remains that accused Nos. 1 and 2 are the borrowers of the loan and the loan was sanctioned in the name of accused No. 1. Accused Nos. 1 and 2 have been granted anticipatory bail by the Co-ordinate Bench of this Court in Crl.P.Nos. 14267/2025
disposed of on 18.11.2025 and Crl.P.No. 14027/2025
disposed of on 05.01.2026 respectively. Petitioner is a married lady who has no other criminal antecedents. She

5. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following:
ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No. 54/2025 registered by V.V.Puram Police Station, Mysuru, for the offences punishable under Sections 417, 406, 420, 465, 467, 468 read with Section 34 of IPC, subject to the following conditions: a. The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal

Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c. Petitioner shall not tamper with the prosecution witness and she shall co- operate with the police for investigation and appear before them whenever called upon. d.
