JUSTICE RAJIV ROY ORAL ORDER 2 29-06-2026 Heard Mr.Amresh Kumar Sinha, learned counsel for the petitioner and the State. 2. The present petition has been preferred for the following relief/s: Patna High Court CWJC No.9025 of 2026(2) dt.29-06-2026 2/4 (i) to issue a Writ (S) CERTIORARI in nature setting aside the order dt. 09/06/2024 and 16/10/2024 passed in mutation case no. 242/2024-2025, 4734/2024-2025 and 4732024-2025, 36/05/2026 passed by Cireles 473 Officer, Patliputra Circle, Patna Sadar, Patna by which order of mutation has been passed in favour of respondent no. 8 to 10 on wrong submission of documents showing respondent no. 8 only legal heirs of late Ishwardhari Sinha; (ii) to issue a Writ (S) CERTIORARI in nature setting aside the order dt. 26/05/2026 passed by Circle Officer, Patliputra Circle. Patna Sadar, Patna by which applications of petitioner having Mutation case no. 10/2026- 27, 11/2026-27 and 12/2026-27 with regards to khata no. 534, plot no. 68 area, 3.125 decimal, Khata no. 534 plot no. 68 area 1.5625 decimal and Khata no. 534, plot no. 67 area 1.5625 decimal for mutation of his purchased land has been rejected on objection raised by respondents no. 8 to 10; Patna High Court CWJC No.9025 of 2026(2) dt.29-06-2026 3/4 (iii) to issue a Writ (S) "MANDAMUS" in nature directing the respondent no. 3 to pass final order in Mutation appeal no. 284/2026- 27, 285/2026-27 and 286/2026-27 which is kept pending in which the order dt. 09/06/2024 and 16/10/2024 passed in mutation case no. 242/2024-2025, 4734/2024- 2025 and 4734/2024-2025, passed by Circle Officer, Patliputra Circle, Patna Sadar, Patna is under challenge by which applications of respondents no. 8 to 10 was illegally allowed without proper enquiry. And thus vide order dt. 26/05/2026 petitioner's Mutation case no. 10/2026-27, 11/2026-27 and 12/2026-27 with regards to khata no. 534, plot no. 68 area, 3.125 decimal, Khata no. 534 plot no. 68 area 1.5625 decimal and Khata no. 534, plot no. 67 area 1.5625 decimal for mutation of his purchased land has been rejected on objection raised by respondents no. 8 to 10; (iv) further to issue a Writ (S) MANDAMUS in nature directing the respondent no.4, the Circle Officer, Patliputra Circle, Patna Sadar, Patna High Court CWJC No.9025 of 2026(2) dt.29-06-2026 4/4 Patna to mutate the land in question in favor of petitioner since he has purchased the land from owner of the land; (v) to any other relief (S) for which petitioners are entitled for in the facts and circumstances of the case. 3. After some argument, learned counsel for the petitioner submits that he shall be satisfied,if direction is issued to the respondent no.03 to pass final order in Mutation Appeal No. 284 of 2026-27 with analogous cases (285 of 2026-27 and 286 of 2026-27). 4. Learned State counsel has no objection to it and submits that once the pleadings completed, an appropriate order shall be passed. 5. Expecting the said respondents to look into the matter and pass an appropriate order in accordance with law, at the earliest, the writ petition is disposed of. Ravi/- (Rajiv Roy, J) U
