VIBHU BAKHRU, CHIEF JUSTICE and HON'BLE MRS. JUSTICE K.S. HEMALEKHA ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE) 1. The complainant has filed the present complaint alleging willful disobedience of the order dated 06.11.2024 passed by the learned Single Judge of this Court in W.P.No.27956/2024 (S-RES). 2. In terms of the said order, the learned Single Judge rejected the contention of the accused that the complainant is ineligible for pension in view of the order dated 09.04.2001 passed by the III Additional District Judge and Educational Appellate Tribunal (EAT), D.K.Mangaluru. There is no dispute that in terms of the said order the complainant was directed to reinstate with continuity of service with effect from 14.06.1998 - 4 - HC-KAR NC: 2026:KHC:28544-DB CCC No. 781 of 2025 and he is also entitled to salary period from the said date upto the date of reinstatement. 3. The accused has filed an affidavit of compliance, inter alia, enclosing therewith an endorsement dated 12.03.2026. 4. The learned Additional Government Advocate appearing for the accused submits that although the approval has been granted for processing the claim of the pension, however, the complainant's claim for granting promotion under the Carrier Advancement Scheme (CAS) has not been granted, raising a ground that not every employee is entitled to benefit and the scheme. It requires to be examined on its merits. 5. The learned counsel for the complainant seeks liberty to challenge the said endorsement. 6. In view of the above, the present complaint is closed. However, if the pension is not disbursed to the complainant within a period of three months from date, the complainant is at liberty to revive the present complaint. This order will not - 5 - HC-KAR NC: 2026:KHC:28544-DB CCC No. 781 of 2025 preclude the complainant from availing any substantive remedy in respect of other claims including increase in salary on account of promotion under CAS.
