Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that co-accused Deep Singh and Pradeep Singh have been enlarged on bail by this Court vide order dated 03.12.2025 as well as the other co-accused Balveer Singh has also got benefit of bail by this Court vide order dated 06.01.2026. He again submits that case of the petitioner is similar in nature. He averred that other star witnesses of the case Ashish Mehta PW-4 and Khushi Kanwar PW-5 have not [2026:RJ-JP:898] (2 of 2) [CRLMB-17046/2025] supported the prosecution story and turned hostile except these there are no other eye-witness who have thrown any positive light on the prosecution story. He further submits that petitioner is behind the bars since 14.11.2024. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody. In view of the absence of any incriminating statement against the petitioner and on the ground of parity with other co-accused the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Arvind Singh S/o Shivraj Singh, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
