[2026:RJ-JP:2163] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 17033/2025 Shivraj S/o Ramprasad, Aged About 25 Years, R/o Nechhwa, Police Station Nechhwa, District Sikar. (At Present In Sub Jail, Fatehpur, Sikar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Hansraj Kuldeep, Adv. For Respondent(s) : Mr. Rhishiraj Singh Rathore, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 19/01/2026 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.201/2025, registered at Police Station Nechhwa, District Sikar, for the offence(s) under Sections 3, 8 of Rajasthan Bovine Animal (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Act, 1995 and Section 325 of BNS. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. The allegation of causing death of bovine animal by running over the vehicle is against the other co-accused Premchand Banvari. The accused-petitioner is in custody since long and the charge-sheet has already been submitted. There are no criminal antecedents against the accused-petitioner and the trial of the case may take [2026:RJ-JP:2163] (2 of 2) [CRLMB-17033/2025] considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on the record. 5. Considering the fact that the main allegation of causing the death of the bovine animal by running over the vehicle is against the other co-accused, namely Premchand Banvari and that no overt act has been attributed to the present accused-petitioner, without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Shivraj S/o Ramprasad, in connection with FIR No.201/2025, registered at Police Station Nechhwa, District Sikar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
