GP FOR SERVICES I The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.13131 of 2026 ORDER: The present writ petition is filed seeking the following relief: “….to issue a writ order or direction more particularly one in the nature of writ of Mandamus to declare the delay and inaction on the part of the Respondents in paying the encashment of Leave as sanctioned by the 4th Respondent to the Petitioners as arbitrary, illegal and violation of Articles 14 and 21 of constitution of India consequently direct the respondents to pay the encashment of Leaves as sanctioned by the 4th Respondent to the Petitioners forthwith along with interest at 9% from the date they fell due for payment till realization in terms of law laid down by the Honble Apex Court reported in 2022(4) SCC 627 and W.A. No. 383 of 2022 dated 12.07.2022….” 2. The petitioners had retired from service on attaining the age of superannuation after serving in the respondent Corporation for several years. The petitioners were not paid earned leave of 300 days as on the date of retirement. The respondent authorities issued the proceedings to draw and disburse the earned leave to the petitioners. As the same is not being disbursed, the present writ petition is filed. 4 3. Learned counsel for the petitioners submits that in similar facts and circumstances, this Court has already granted relief in W.P.No.36187 of 2025 by order dated 31.12.2025 and therefore, the petitioners are also entitled to the same relief. 4. Sri K.Mallikharjuna Moorthy, learned Standing Counsel for A.P. Housing Corporation Limited, also does not dispute this fact. 5. Considering the said submissions and in view of the order dated 31.12.2025 passed by this Court in W.P.No.36187 of 2025, the present Writ Petition is disposed of with a direction to the respondents to disburse the amount due to the petitioners with applicable rate of interest within a period of three (3) months from today. There shall be no order as to costs.
