Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce the minor children of the petitioner.
5. Issue notice.
6. Notice is accepted on behalf of the respondent nos. 1 to 3 by Mr.Aman Usman, the learned APP for the State.
7. Admittedly, the minor children were residing at Gaur City, Noida, Uttar Pradesh, when they are alleged to have been illegally taken away by the respondent no. 8, their father.
8. Given the above fact, we are of the opinion that this Court would not have the territorial jurisdiction to entertain the present writ petition.
9. The petition is, accordingly, dismissed, leaving it open to the petitioner to avail of her remedies in accordance with law before a court of competent jurisdiction.
