By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘ the BNSS, 2023’), the petitioner seeks quashment of First Information Report dated 15.04.2023 registered as Crime No. 318/2023 at Police Station Supela, District Durg (C.G.), for the offences punishable under Sections 294, 323, 354, 506 and 34 of Indian Penal Code (in short, ‘IPC;) and Sections 8 and 12 of the Protection of Children from Sexual Offences AKHILESH BEOHAR Digitally signed by AKHILESH BEOHAR Date: 2026.06.09 16:33:15 +0530
2 Act, 2012 (in short, ‘the POCSO Act, 2012’), along with all consequential proceedings arising therefrom.
2. Learned counsel for the petitioner submits that the alleged incident relates to the year 2018 and the FIR has been lodged after a delay of about five years. However, the record shows that the prosecution evidence is almost completed and the trial is at the final stage. Therefore, at this stage, it would not be appropriate for this Court to interfere in the matter.
3. Considering the facts and circumstances of the case, this Court is of the view that no case for interference is made out. It is made clear that this Court has not expressed any opinion on the merits of the case. The learned trial Court shall proceed in accordance with law on the basis of the evidence and material available on record.
