No. 448 of 2016, registered with Khar Police Station, Mumbai, for the offence p. 2 SANJAY ASARAM MANDAWGAD Digitally signed by SANJAY ASARAM MANDAWGAD Date: 2026.10.19 14:47:20 +0530 SA_MANDAWGAD 10,17-WP1047-25GR.DOC punishable under Sections 498A, 406, 323, 506, 509 and Section 34 of the Indian Penal Code, 1860 (“IPC”), on the basis of the report dated 26.09.2016 lodged by the Respondent No. 2 (“the victim”). 3. Petitioners, namely, Aditya Chandru Pardasany, Vriddhi Chandru Pardasany and Anusha Chandru Pardasany, are respectively the husband, sister-in-law and mother-in-law of the victim. Petitioner Aditya Pardasany and the victim got married with each-other on 27.03.2016. After the marriage, the victim went to cohabit with the petitioners family. It is alleged that, from 27.03.2016 until the lodging of the report, the petitioners subjected the victim to cruelty in connection with their unlawful demand for money. When the victim was pregnant, the petitioner husband and mother-in-law assaulted her with kicks and fist and driven her out of the house. They removed and misappropriated her stridhan and other valuable gift articles. Upon her questioning for the same, she was abused and assaulted by the petitioners. In the background, the aforesaid crime came to be registered and chargesheet was filed. 4. The learned Advocate for the parties stated that, now, the matter has been amicably settled between the parties through mediation. The marriage between Petitioner-Aditya Pardasany and the victim has been dissolved by a decree of divorce on 18.08.2016 passed by the Supreme Court of the Republic of Indonesia. The victim has received an amount of Rs. 85,00,000/- as full and final settlement. The parties don’t have any claims against each other. Therefore, the victim does not want to prosecute the petitioners in the aforesaid crime and, she has given her consent and no objection to quashing and setting aside the p. 3 SA_MANDAWGAD 10,17-WP1047-25GR.DOC aforesaid crime. The Affidavit sworn by the victim to that effect is filed through e-filing. Mr. Shah, learned Advocate for Respondent No. 2, tendered a copy of the Affidavit. It is taken on record and marked ‘X’ for identification. The copy of the consent terms is attached with the petition. 5. The victim is present through video conferencing and she is identified by Mr. Shah. She has reiterated the contents of the said Affidavit and states that, in view of the settlement and execution of the consent terms, she does not want to prosecute the petitioners in the aforesaid crime and hence she has given her consent and no objection to quashing and setting aside the aforesaid crime. As both the parties want to move ahead in life, therefore, no purpose will be served by continuing the proceedings arising out of the impugned FIR and consequent criminal case. 6. In view thereof, all the Petitions are allowed. Hence, Order :- (a) The proceedings in criminal case bearing No.PW/1191/2019, pending before the learned Additional Chief Metropolitan Magistrate, 9th Court, Bandra, Mumbai, arising out of an FIR bearing Cr.
