The revisional application has been preferred praying for transfer of Matrimonial Suit no. 78 of 2020 from the Court of the Learned Additional District Judge at Katwa, District – Purba Burdwan to the Court of the Learned District Judge, 24 Parganas (North) at Barasat. 2. Learned counsel for the petitioner has filed two supplementary affidavits, placing additional documents to substantiate his argument that the opposite party/wife has a residence in Kolkata and as such he prays that the matrimonial suit filed by the wife/opposite party be transferred to Barasat Court. 3. On the other hand, learned counsel for the wife/opposite party submits that the 1 2 wife/opposite party along with her two children is a permanent resident of Katwa and as such has filed the case at Katwa. 4. Learned counsel for the opposite party has relied upon an order dated 03.04.2024 passed in CRR 3393 of 2022, between the parties herein, wherein also the present petitioner had prayed for transfer of proceedings under Section 125 of Cr. P. C. 5. The prayer for transfer was on the self-same ground. 6. The petitioner/husband has filed further documents to show that the petitioner resides in Kolkata. 7. But the opposite party has strongly objected to the said prayer stating that one of the opposite party’s daughters is studying in Kolkata and she occasionally visits her in Kolkata but she is a permanent resident of Katwa. 8. Considering the said facts and in view of the order dated 03.04.2024 passed in CRR 3393 of 2022, this Court rejects the prayer for transfer made by the petitioner herein as no new grounds have been made out to consider the said prayer for transfer. 9. CO 1288 of 2020 stands dismissed and accordingly disposed of. 2 3 10. All connected applications, if any, stand disposed of. 11. Interim order, if any, stands vacated. 12.
