ORAL ORDER Heard Sri. B.N.Anjan Kumar, learned counsel for the petitioner.
2. This writ petition is filed seeking a direction to the Court of II Additional Senior Civil Judge and JMFC, Anekal Bengaluru Rural District, Bengaluru (hereinafter referred to as the ‘Family Court’) to dispose of M.C.No.164/2023 which is pending on its file time bound.

Learned counsel for the petitioner submits that petitioner is the husband of the respondent. The respondent filed M.C.No.164/2023 seeking to grant relief of divorce between the petitioner and the respondent under Section 13(1)(ia) of the Hindu Marriage Act, 1955 against the respondent. It is also submitted that the respondent is not ready and willing to lead the evidence and only with an intention to harass the husband filed the petition for divorce and not leading her evidence. The

respondent is not showing any interest in prosecuting the case and for one or the other reason dragging the proceeding since from last 3 years and being aggrieved by the same, this writ petition is filed.
4. Record discloses justification in the submission that is made by learned counsel for the petitioner. Therefore, this Court considers desirable to dispose of the writ petition and give directions. Hence, the following:
ORDER (i) Writ petition is disposed of. (ii) The Court of II Additional Senior Civil Judge and JMFC, Anekal, Bengaluru Rural District, Bengaluru is directed to take all steps for disposal of MC No.164/2023 as expeditiously as possible. (iii) This Court is not issuing the notice to the respondent as no adverse orders are passed and disposed of the petition in the interest of both the parties.

(iv) As the writ petition is disposed of without notice to the respondent, Family Court is directed to serve copy of this order to the respondent so as to give notice to the respondent, about filing of this petition and its disposal. (v) Registry to forward copy of this order to the concerned Court forthwith.
