By this petition, the petitioner seeks direction and setting aside the impugned order of respondents and also seeks Stay to Departmental Enquiry. 3. As per contentions of the petitioner, he is diagnosed as “Psychiatric Disorder” which has already been recognized, treated, and medically categorized by respondents. The Departmental Enquiry is initiated against him and it is at the fag end. Due to his disability, he is unable to attend the Departmental Enquiry and, therefore, it be stayed. 4. Learned DSGI for respondents, upon instructions, submits that if the petitioner agrees to remain present before the Medical Board at AIIMS, an opportunity of rehearing can be granted to 2 15 wp6113.26.odt the petitioner after he is examined by the Medical Board and issuance of Medical Certificate by the Medical Board. 5. In view of the said statement of learned DSGI for respondents, the petition is disposed of with directions that the petitioner shall remain present before the Medical Board at AIIMS. Respondent No.8 shall communicate date to the petitioner for remaining present before the Medical Board. After the Medical Board examines the petitioner and issues Medical Certificate, respondent no.8 shall give an opportunity of rehearing to the petitioner. Petition stands disposed of accordingly.
