1. This petition has been filed by the petitioner seeking for the following relief(s):-
“I. Direct Respondent No.2 to consider and
decide
the
petitioner's representation/application

2 18.05.2026 in accordance with law within a stipulated period as may be deemed fit by this Hon'ble Court. II. Direct the respondents to take appropriate action under Rule 14 and Rule 15 of the Chhattisgarh Municipal Corporation
and
Municipalities (Registration of Colonizer, Terms and Conditions) Rules, 2013 and under Section 339-E of the Chhattisgarh Municipalities Act, 1961 III. It is further prayed that sale and registry of plot may be prohibited. IV. Pass any other order/orders which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.”

Learned counsel for the petitioner submits that the petitioner has already submitted an application/representation/complaint dated 18.05.2026 (Annexure P/1) before the Chief Municipal Officer, Municipal Council Bodri, Bilaspur, Chhattisgarh, ventilating his grievances. However, the said application/representation/ complaint is still pending consideration and has not been decided by the competent authority till date. He further submits that the petitioner would be satisfied if the present petition is disposed of with a direction to the respondent authorities to consider and decide the aforesaid pending application/representation/ complaint within such reasonable period as may be fixed by this Court, strictly in accordance with law. 3
3. Mr. Amrito Das, learned Senior Advocate, assisted by Mr.
Yashkarn Singh, Advocate, appearing on behalf of the partners of the firm, namely, M/s. Fortune Buildcon, Bilaspur, submits that the petitioner has deliberately failed to implead the partners of the said firm as necessary parties to the present petition and is seeking relief behind their back. He further submits that a perusal of the application/complaint dated 18.05.2026 would reveal that a copy thereof, which ought to have been furnished to the concerned partners of the firm, has not been supplied to them. It is, therefore, contended that appropriate directions may be issued to the petitioner to furnish a copy of the complaint/application to the concerned partners/affected parties, if any, by impleading them as necessary parties therein, so as to enable the competent authority to consider and decide the said application in accordance with law after affording due opportunity of hearing to all affected and interested parties. 4. No advance copy has been served to the Municipal Council Bodri, Bilaspur. 5. I have heard learned counsel for the parties, perused the documents available on record with utmost circumspection and particularly, the orders impugned herein. 6. Without expressing any opinion on the merits of the case, this petition is disposed of with a direction to the petitioner that he shall submit afresh application/representation/complaint within a
4 period of 07 days from the date of receipt of copy of this order before the competent authority by impleading the partners of Fortune Buildcon, Bilaspur as necessary parties and shall furnish a copy thereof to them under due acknowledgment.
Upon receipt of such application, it shall be open to the said parties to file their objections before the competent authority and the authorities concerned shall thereafter consider the application/representation/ complaint of the petitioner and also objections, after affording due opportunity of hearing to all concerned parties, and thereafter pass an order strictly in accordance with law within a period of 60 days from the date of receipt of application/ representation/complaint submitted by the petitioner. 7.
